1. Acceptance of Terms
By accessing or using the mkt-strategepro platform (the "Service") you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.
3. Accounts & Security
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- You must notify us immediately at security@mkt-strategepro.com of any unauthorized access.
- You must provide accurate, current, and complete information when registering.
4. Subscriptions & Billing
- Paid plans renew automatically each billing cycle (monthly or yearly) until cancelled.
- Fees are charged in advance and are non-refundable except where required by law.
- You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
- We may change plans, features, or prices with at least 30 days' notice. Continued use after changes constitutes acceptance.
- Free plans may include advertisements and feature limits.
5. Acceptable Use
You agree not to:
- Violate any law, regulation, or third-party rights.
- Send spam, deceptive, or unsolicited communications.
- Upload malware, attempt to disrupt the Service, or probe for vulnerabilities outside our disclosure program.
- Reverse-engineer, scrape, or copy the Service except as expressly permitted.
- Use the Service to generate, distribute, or amplify hate, harassment, or sexually exploitative material.
- Resell or sublicense the Service without a written agreement.
We may suspend or terminate accounts that violate these rules.
6. Your Content
You retain all rights to content you upload or create through the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely as needed to provide and improve the Service.
7. AI-Generated Content
The Service offers AI-assisted features (content generation, recommendations, insights). Output may be inaccurate, biased, or inappropriate; you are responsible for reviewing AI output before publishing or acting on it. We do not claim ownership of AI output generated for your account, but we make no warranty that it is unique or non-infringing.
8. Third-Party Services
The Service integrates with third-party platforms (advertising, analytics, payments, social networks). Your use of those services is governed by their own terms. We are not responsible for third-party availability, content, or practices.
9. Intellectual Property
The Service, including software, design, trademarks, and documentation, is owned by mkt-strategepro and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, OR DATA.
12. Indemnification
You agree to indemnify and hold harmless mkt-strategepro and its affiliates, officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your breach of these Terms.
13. Termination
You may terminate your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases; sections that by their nature should survive termination will survive.
14. Governing Law
These Terms are governed by the laws of the Republic of Cameroon, without regard to conflict-of-law rules. The courts located in Yaoundé shall have exclusive jurisdiction over any dispute, except where mandatory consumer-protection laws of your residence apply.
15. Changes to Terms
We may modify these Terms from time to time. Material changes will be communicated via the Service or email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
